Submitting properties you don't own or have authority to sell
Using our services for any illegal purpose
Attempting to circumvent our systems or security measures
4. Cash Offers
Nature of Offers:
Our offers are typically below full market value
Offers are subject to property verification
Timeline estimates are not guaranteed
We reserve the right to withdraw or modify offers
No Obligation: Requesting an offer creates no obligation to sell your property to us.
5. Communications
By providing your contact information, you consent to receive communications from us as described in our Privacy Policy. You may opt-out of marketing communications at any time.
6. Intellectual Property
All content on our website, including text, graphics, logos, and software, is owned by or licensed to Pace Home Buyers and protected by copyright and trademark laws.
7. Disclaimers
AS-IS BASIS: Our services are provided "as is" without warranties of any kind, either express or implied.
NO GUARANTEE: We do not guarantee:
That we will purchase your property
Any specific offer amount
Any specific timeline
The accuracy of property valuations
THIRD-PARTY SERVICES: We are not responsible for third-party services (inspectors, title companies, etc.) involved in transactions.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACE HOME BUYERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability shall not exceed the amount of any earnest money deposit we have paid to you.
9. Indemnification
You agree to indemnify and hold harmless Pace Home Buyers from any claims, damages, or expenses arising from:
Your use of our services
Your violation of these Terms
Your violation of any third-party rights
Any misrepresentation about property ownership or condition
10. Arbitration Agreement
PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS:
Binding Arbitration: Any dispute arising from these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
Class Action Waiver: YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Disputes must be brought individually.
Exceptions: Small claims court actions and injunctive relief for intellectual property violations are excluded from arbitration.
Opt-Out: You may opt-out of arbitration by notifying us in writing within 30 days of accepting these Terms.
11. Governing Law
These Terms are governed by the laws of New York, without regard to conflict of law principles.
12. Termination
We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including breach of these Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting.
14. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pace Home Buyers regarding our services.
16. Connecticut-Specific Terms
For Connecticut properties: Sellers will receive a $500 credit at closing if no property condition report is provided as required by Connecticut General Statutes § 20-327b.
17. New York-Specific Terms
We comply with all applicable New York real estate laws and cease-and-desist zone regulations. We are not acting as real estate brokers in jurisdictions where not licensed.
